R-9.1 - Act respecting the Pension Plan of Certain Teachers

5. A person who holds pensionable employment under the Teachers Pension Plan or the Civil Service Superannuation Plan shall, to be entitled to benefits under this plan, elect to become a member of this plan by sending a notice to that effect. This plan shall apply to the person from the first day of the month not less than three months after receipt of the notice.

However, if the pension of that person becomes payable before the date on which this plan becomes applicable to him pursuant to the first paragraph, this plan is deemed to apply to him from the date on which the pension becomes payable.

5. A person who holds employment that is pensionable employment under the Teachers Pension Plan or the Civil Service Superannuation Plan must, to be entitled to benefits under this plan, elect to become a member of this plan in the manner set out in section 13 of the Act respecting the Government and Public Employees Retirement Plan (chapter R-10) even if he holds employment with an employer who is not subject to the said Act.

If, however, that person’s pension becomes payable before the date this plan becomes applicable to him as determined under the said section 13, the person is deemed to be subject to this plan from the date the pension becomes payable.

5. A person contributing to the Teachers Pension Plan or to the Civil Service Superannuation Plan must, to become eligible for benefits under this plan, elect in favour of this plan in accordance with section 13 of the Act respecting the Government and Public Employees Retirement Plan (chapter R-10) even if he is holding an employment with an employer not contemplated in the said Act.

If, however, that person’s pension becomes payable before the date the plan becomes applicable to him as determined under the said section 13, the person is deemed to have become a member on the date the pension becomes payable.
