R-12 - Act respecting the Civil Service Superannuation Plan

53. The plan provided for under this division does not apply to an officer who
(1)  is excluded by reason of his class or conditions of employment or his remuneration or mode of remuneration as determined by regulation;
(2)  is a member of a retirement plan provided for in the Courts of Justice Act (chapter T-16);
(3)  is a member of the Sûreté du Québec;
(4)  is a Member of the National Assembly;
(5)  is an employee who is a member of the Pension Plan of Peace Officers in Correctional Services;
(6)  belongs to a class of employees designated under the first paragraph of section 23 of the Act respecting the Pension Plan of Management Personnel (chapter R-12.1), except where he makes the election provided for in the third paragraph of that section.

53. The plan provided for under this division does not apply to an officer who

(3)  is a member of the Sûreté du Québec;
(4)  is a Member of the National Assembly;
(5)  is an employee who is a member of the Pension Plan of Peace Officers in Correctional Services;
(6)  belongs to a class of employees designated under the first paragraph of section 10.1 of the Act respecting the Government and Public Employees Retirement Plan (chapter R-10), except where he makes the election provided for in the third paragraph of that section.

(2)  a person who comes under a retirement plan provided for in the Courts of Justice Act (chapter T-16);
(3)  a member of the Sûreté du Québec;
(4)  a member of the National Assembly;
(5)  an officer belonging to a category designated by regulation.

53. The plan provided for under this division does not apply to
(1)  an officer who is employed on a casual basis within the meaning of the regulations;
(2)  a person who comes under a retirement plan provided for in the Courts of Justice Act (chapter T-16);
(3)  a member of the Sûreté du Québec;
(4)  a member of the National Assembly;
(5)  an officer belonging to a category designated by regulation.

53. This Division shall not apply to the persons to whom Division I of this act, or sections 100 to 108 of the Courts of Justice Act (chapter T-16) apply.
Subject to such reservations, it applies to every officer or employee of the Government, unless employed only occasionally within the meaning of the regulations made for that purpose by the Government.
Nevertheless, it shall not apply to an officer or employee appointed after the 1st of January 1966, until the month following his eighteenth birthday.
It shall not apply to a person who is a member of the Sûreté du Québec within the meaning of the Police Act (chapter P-13) on the 1st of September 1971 or becomes a member after such date.
