R-12 - Act respecting the Civil Service Superannuation Plan

20. Notwithstanding section 19, any lump sum paid as an increase or adjustment of the pensionable salary for a previous year shall form part of the pensionable salary of the year in which it is paid.
However, where the lump sum is paid in a year during which no service is credited, it shall be included in the pensionable salary of the last year during which service is credited to him prior to payment of the lump sum.
Any part of the lump sum that is attributable to an increase or adjustment of the salary paid to a pensioner for any period during which he is not an officer for the purposes of the plan provided for in this division, even if he holds pensionable employment under that plan, shall be excluded.

(1)  in the case of a public officer, in the pensionable salary for the year during which the lump sum is paid;
(2)  in the case of a pensioner, in the pensionable salary for the year in which he retired.
The lump sum does not include that part of the amount attributable to an increase of or adjustment to the salary paid while the pensioner is contemplated in section 24.1 or in the Act respecting the Government and Public Employees Retirement Plan (chapter R-10), or the Act respecting the Teachers Pension Plan (chapter R-11).

(2)  in the case of a pensioner, in the pensionable salary for the year in which he retired.

20. Any lump sum paid to a public officer or employee as an increase of or readjustment to his salary for a previous calendar year is part of the pensionable salary for the year during which it is paid.
However, such a lump sum paid to a public officer or employee in the year immediately following the year in which he was superannuated is part of the pensionable salary for the year in which the officer or employee was superannuated.
