R-11 - Act respecting the Teachers Pension Plan

14. The pensionable salary of a teacher in any calendar year shall not be less than the basic salary to which he is entitled in that year, determined in accordance with the conditions of employment applicable to him and taking into account the third paragraph of section 11, with the exception of any lump sum paid subsequently as an increase or adjustment of the pensionable salary for that year.

14. 14. In no case may the pensionable salary of a teacher in the course of a year in which he receives his full salary be less than the salary provided for his class on the salary scale corresponding to his classification in accordance with the conditions of employment governing him.

14. Every lump sum paid as a salary increase or readjustment for a previous year is part,
(1)  in the case of a teacher, of the pensionable salary for the year during which the lump sum is paid;
(2)  in the case of a pensioner, of the pensionable salary for the year during which he retired.
The lump sum does not include that part of the amount which is attributable to an increase of or readjustment to the salary paid while the pensioner is contemplated in section 8.2 or in the Act respecting the Government and Public Employees Retirement Plan (chapter R-10) or the Act respecting the Civil Service Superannuation Plan (chapter R-12).

14. Every lump sum paid to a teacher as an increase of or readjustment to his salary for a previous calendar year is part of the pensionable salary for the year during which it is paid.
However, such a lump sum paid to a teacher in the year following the year in which he was superannuated is part of the pensionable salary for the year during which he was superannuated.
