R-10 - Act respecting the Government and Public Employees Retirement Plan

2. The plan also applies to
(1)  any employee whose supplemental pension plan with an employer party to the plan was terminated after 30 June 1973 by reason of an amendment made to the supplemental pension plan, except an employee of a research centre within the meaning of section 6.2;
(2)  a member of the staff of the Lieutenant-Governor, of a minister or of a person referred to in section 124.1 of the Act respecting the National Assembly (chapter A-23.1) who is not entitled to assignment or re-assignment to a position where this plan or the Pension Plan of Management Personnel would apply to the employee if the member applies to Retraite Québec to have the plan apply to the employee, except where the member can avail themself of section 9.0.1 of the Act respecting the Teachers Pension Plan (chapter R-11) or section 54 of the Act respecting the Civil Service Superannuation Plan (chapter R-12). The plan is applicable to the member from the date specified in the employee's application, which may precede by not more than 12 months the date on which Retraite Québec receives the application but may not be prior to the date on which the employee became such a member;
(3)  an employee who is released without pay by their employer for union activities and who is in the employ of a body designated in Schedule II.1 if the employee belongs to the class of employees mentioned in that schedule in respect of that body.

2. The plan also applies to

(1)  a full-time member of a body established under an Act of Québec if the member applies therefor and the Government makes an order to that effect;
(2)  to an administrator of state within the meaning of the Public Service Act (chapter F-3.1.1) or the chief executive officer of an agency who becomes an employee or full time member of a university institution or of an organization designated by the Government if he applies to continue his participation in the plan and if the Government makes an order to that effect;
(3)  any employee whose supplemental pension plan with an employer contemplated by the plan was terminated after 30 June 1973 by reason of an amendment brought to such supplemental pension plan;
(4)  a person engaged by contract by the Government under section 57 of the Public Service Act if the person applies therefor and if the Government issues an order to that effect;
(5)  a member of the staff of a minister or of a person referred to in section 124.1 of the Act respecting the National Assembly (chapter A-23.1) who is not entitled to assignment or re-assignment to a position where this plan would apply to him if, at his request, the Government adopts an order to that effect, except where he can avail himself of section 4.1 of the Act respecting the Pension Plan of Peace Officers in Correctional Services (chapter R-9.2), section 9.0.1 of the Act respecting the Teachers Pension Plan (chapter R-11) and section 54 of the Act respecting the Civil Service Superannuation Plan (chapter R-12);

2. From July 1 1973, a retirement plan is established and, subject to sections 4 to 14, applies to the following salaried persons:
(1)  the employees of the Government;
(2)  the employees of:
(a)   public establishments, health and social service councils and private establishments under agreement within the meaning of the Act respecting health services and social services (chapter S-5) but only, in the case of private establishments, those under agreement for the objects determined by regulation;
(b)  school boards and regional school boards within the meaning of the Education Act (chapter I-14) and general and vocational colleges;
(c)  private educational institutions declared of public interest or recognized for purposes of grants by virtue of the Act respecting private education (chapter E-9);
(d)  the Société des Traversiers du Québec, with the exception of the mechanics of the company in respect of whom the Canadian Marine Officers Union is certified;
(e)  the Société des alcools du Québec;
(f)  the Manpower Vocational Training Commissions established by virtue of chapter F-5;
(f.1)  the Town of Vaudreuil that were, on 31 May 1981, employees of the Station expérimentale de Vaudreuil;
(f.2)  the École Socrates;
(f.3)  the University of Québec contemplated in the Teachers Pension Plan or the Civil Service Superannuation Plan if an employee elects as in section 10;
(g)  any other body or institution to which this act is made applicable by statute or by a regulation of the Government;
(3)  the chairman of the Conseil du statut de la femme;
(4)   the president of the Office de la langue française;
(5)  the members of the Commission des affaires sociales and the assessors of the said Commission who receive an annual remuneration;
(6)  repealed;
(7)  the members of the Régie du logement employed full-time and remunerated on an annual basis;
(8)  the members of the Société québécoise d’initiatives agro-alimentaires;
(9)  the members and employees of the Régie des installations olympiques;

(4)  the president and the two vice-presidents of the Office de la langue française;
(5)  the members of the Commission des affaires sociales and the assessors of the said Commission who receive an annual remuneration;
(6)  the president of the Commission administrative des régimes d’assurance-stabilisation des revenus agricoles;
(7)  the members of the Commission des loyers employed full-time and remunerated on an annual basis;
(8)  the members of the Société québécoise d’initiatives agro-alimentaires;
(9)  the members and employees of the Régie des installations olympiques;
(10)  the chairman of the Régie de l’assurance automobile du Québec;
(11)  the chairman of the Office des personnes handicapées du Québec;
(12)  the president and employees of the Société des loteries et courses du Québec;
(13)  the director general and the employees of the Institut national de productivitié;
(14)  the employees of the Société québécoise de développement des industries culturelles;
(15)  to the members of the Bureau d’audiences publiques sur l’environnement who are appointed under the first paragraph of section 6.2 of the Environment Quality Act (chapter Q-2).
A casual employee as defined by regulation and an employee under eighteen years of age are not employees contemplated by this act. The same applies to a person employed on a one lesson or one medical act basis, a resident physician or an intern, or a person employed on an intermittent basis in accordance with the criteria established by regulation.

2. From July 1 1973, a retirement plan is established and, subject to sections 4 to 14, applies to the following salaried persons:
(1)  the employees of the Gouvernement;
(2)  the employees of:
(a)  public establishments and private establishments under agreement within the meaning of the Act respecting health services and social services (chapter S-5) but only, in the case of private establishments, those under agreement for the objects determined by regulation;
(b)  school boards and regional school boards within the meaning of the Education Act (chapter I-14) and general and vocational colleges;
(c)  private educational institutions declared of public interest or recognized for purposes of grants by virtue of the Act respecting private education (chapter E-9);
(d)  the Société des Traversiers du Québec, with the exception of the mechanics of the company in respect of whom the Canadian Marine Officers Union is certified;
(e)  the Société des alcools du Québec;
(f)  the Manpower Vocational Training Commissions established by virtue of chapter F-5;
(g)  any other body or institution to which this act is made applicable by statute or by a regulation of the Gouvernement;
(3)  the chairman of the Conseil du statut de la femme;
(4)  the president and the two vice-presidents of the Office de la langue française;
