42. If an operator of a waterworks or sewer system, other than a municipality, is unable to acquire by agreement an immovable or any other real right required to operate the waterworks or sewer system, the operator may, with the Minister’s authorization, expropriate the immovable or real rights concerned.

42. Where the holder of a permit contemplated in section 32.1 cannot acquire by agreement a source of water supply or an immovable or other real rights required for his waterworks or sewer system, he may, with the authorization of the Minister, expropriate such source and the immovables or other real rights required.

42. When a person holding a permit of the Director for the operation of a waterworks, sewer or water treatment plant cannot acquire by agreement a source of water supply or an immoveable for its operation, he may, with the authorization of the Minister, expropriate such source and the immoveables required for the installation of the necessary buildings and machinery there.
