109.1.2. Where a person is convicted of an offence under a provision of this Act, a judge may, on an application by the prosecutor which is attached to the statement of offence, in addition to imposing any other penalty, impose an additional fine of an amount equal to the amount of the monetary benefit acquired by or accrued to the person as a result of the commission of the offence, notwithstanding any maximum fine elsewhere provided imposed upon him.
