106. A natural person who contravenes any of sections 21, 22 and 31.1, the first paragraph of section 31.16, section 31.23, except subparagraphs 1 and 1.1 of the first paragraph, the first paragraph of section 31.25 or 31.28 or any of sections 68, 70.6, 70.7, 91, 95.1, 95.3, 121, 123.1, 154 and 189 commits an offence and is liable to a fine
(a)  of not less than $600 nor more than $20,000 for the first offence; and
(b)  of not less than $4,000 nor more than $40,000 for a second or subsequent conviction.
A natural person commits an offence and is liable to the same penalty who
(a)  proceeds with the carrying out of a project that is the object of a denial of conformity under section 95.4;
(b)  files or signs a false attestation of environmental conformity;
(c)  does not comply with a depollution program approved by the Minister under section 116.2;
(d)  does not comply with a condition imposed under section 31.5, 31.6, 65, 70.8, 164, 167, 201 or 203;

(d.1)  does not comply with a measure determined under section 31.9.9 or 31.9.12;
(e)  (subparagraph repealed);
(f)  (subparagraph repealed);
(g)  does not comply with a condition, restriction or prohibition imposed by the Minister under section 70.12.
A legal person convicted of an offence contemplated in this section is liable to a minimum fine three times higher and to a maximum fine six times higher than those provided in this section.

(a)  of not less than $600 nor more than $20 000 for the first offence; and
(b)  of not less than $4 000 nor more than $40 000 for a second or subsequent conviction.
A natural person commits an offence and is liable to the same penalty who
(a)  proceeds with the carrying out of a project that is the object of a denial of conformity under section 95.4;

(a)  of not less than $600 nor more than $20 000 for the first offence; and
(b)  of not less than $4 000 nor more than $40 000 for any subsequent offence.
A natural person commits an offence and is liable to the same penalty who
(a)  proceeds with the carrying out of a project that is the object of a denial of conformity under section 95.4;
(b)  files or signs a false attestation of environmental conformity;
(c)  does not comply with a depollution programme approved by the Minister under section 116.2;

(a)  of not less than $200 nor more than $5 000 for the first offence; and
(b)  of not less than $400 nor more than $10 000 for any subsequent offence.
A person is guilty of the same offence and liable to the same penalty who
(a)  proceeds with the carrying out of a project that is the subject of a denial of conformity under section 95.4;
(b)  files or signs a false attestation of environmental conformity;
(c)  does not comply with a depollution program approved by the Deputy Minister under section 116.2; or who
(d)  does not comply with a condition imposed under section 31.5, 31.6, 65, 164, 167, 201 or 203;
(e)  does not comply with an agreement entered into with the Deputy Minister respecting the deposit or storage of waste.
A corporation guilty of an offence contemplated in this section is liable to a minimum fine three times higher and to a maximum fine six times higher than those provided in this section.

(a)  of not less than two hundred dollars nor more than five thousand dollars for the first offence; and
(b)  of not less than four hundred dollars nor more than ten thousand dollars for any subsequent offence.
These penalties are applicable, in the same manner, to any person who does not comply with the conditions imposed under section 31.5, 31.6, 164, 167, 201 or 203.
A corporation guilty of an offence contemplated in this section is liable to a minimum fine three times higher and to a maximum fine six times higher than those provided in this section.

106. A natural person who contravenes one or the other of sections 20, 21, 22, 25, 26, 27, 28, 29, 31.1, 49, 68, 72, 73, 91, 114.1, 123.1, 189 or 224 of this act is guilty of an offence and is liable, upon summary proceeding, to a fine
(a)  of not less than two hundred dollars nor more than five thousand dollars for the first offence; and
(b)  of not less than four hundred dollars nor more than ten thousand dollars for any subsequent offence.
These penalties are applicable, in the same manner, to any person who does not comply with the conditions imposed under section 31.5, 31.6, 164, 167, 201 or 203.
A corporation guilty of an offence contemplated in this section is liable to a minimum fine three times higher and to a maximum fine six times higher than those provided in this section.

106. Whoever contravenes section 20, 21, 22, 25, 26, 27, 28, 29, 49, 68 or 91 of this act is guilty of an offence and is liable, upon summary proceeding, to a fine not exceeding five thousand dollars for the first offence and not exceeding ten thousand dollars for any subsequent offence.
