5. If the expropriation relates to a cemetery, the Minister of Sustainable Development, Environment and Parks must, in lieu of payment of an indemnity, take all the requisite steps to relocate the cemetery and transfer the bodies to the new cemetery. The selection of the site of the new cemetery must be approved by the Minister of Health and Social Services and if it is the cemetery of any religious denomination, the selection of the site must be made after consultation with the competent ecclesiastical authority.
Subject to the preceding paragraph, the Act respecting Roman Catholic cemetery companies (chapter C‐40.1) and the Funeral Operations Act (chapter A-5.02) shall not apply while a new cemetery is being established in accordance with this section.
