44. Every person who contravenes any of the following provisions is liable to a fine of $1,000 to $10,000:
(1)  a provision of section 4, except the provision concerning the safe use of a product, or a provision of section 4.1 or of sections 8 to 8.2;
(2)  (paragraph repealed);
(3)  a provision of section 13;
(4)  a provision of a regulation under paragraph e, h or j.1 of section 40 in relation to any false or misleading indication or falsification concerning a product, or a provision of a regulation under paragraph e.2, e.5.1 or e.6 of that section.

44. Every person who contravenes any of the following provisions is liable to a fine of $500 to $3,000 and, for any subsequent contravention, to a fine of $1,500 to $9,000:
(1)  a provision of section 4, except the provision concerning the safe use of a product, or a provision of section 4.1 or of sections 8 to 8.2;
(2)  a provision of any of subparagraphs k.2, k.3 and k.4 of the first paragraph of section 9 in relation to, in the case of the latter subparagraph, a dairy product substitute wholesaler’s permit, or a provision of any of subparagraphs n.1 to n.4 of the first paragraph of that section;
(3)  a provision of section 13;
(4)  a provision of a regulation under paragraph e, h or j.1 of section 40 in relation to any false or misleading indication or falsification concerning a product, or a provision of a regulation under paragraph e.2, e.5.1 or e.6 of that section.

44. Every person who contravenes section 3 in respect of a product unfit for human consumption or deteriorated so that it is unfit for human consumption, any provision of section 5 or 9, an order made under section 33.10 or 33.11, an order made under section 40.2, the stamp regulations or the regulations on the origin of products on the stamping of a production lot number on packagings, on meat unfit for human consumption, on fishery products unfit for human consumption or on the grading of marine products or fresh water products is liable
(a)  for a first offence, to a fine of not less than $1 400 nor more than $7 000;
(b)  for any subsequent conviction, to a fine of not less than $4 250 nor more than $13 975.
Section 52 does not apply to such offences.

Section 52 does not apply to such offences, but Part II of the Summary Convictions Act does apply.
