3. Every offence against this division shall be punishable, for a first offence, by a fine of not less than $1 nor more than $40, with costs, and, in default of payment thereof, by imprisonment for not more than thirty days, and for every subsequent offence by a fine of not more than $100, and, in default of payment, by imprisonment for not more than sixty days.
