44. The Authority may institute penal proceedings with regard to offences under this Act. In such a case, the fine imposed by the court is remitted to the Authority.

44. The Authority may institute penal proceedings with regard to offences under this Act. In such a case, the fine imposed by the court is remitted to the Authority and, despite section 38.2 of the Act respecting the Autorité des marchés financiers (chapter A-33.2), is not paid into the Education and Good Governance Fund.
