L-4.1 - Act respecting electoral lists

50. (1)  On Thursday of the second week preceding that of an annual enumeration, the returning officer shall appoint, in form 5, two enumerators to draw up the list of electors for each urban polling subdivision, one upon the written recommendation of the Prime Minister or of a person designated for such purpose by him in each electoral division and the other upon the written recommendation of the Leader of the Official Opposition or of the person designated for such purpose by him in each electoral division.
However, in each electoral division represented by an opposition member who is not a member of the Official Opposition, or who sits as an independent, having been elected as such, the recommendation of the enumerators provided for in the first paragraph shall be made in such electoral division by that member or by the delegate designated by him in writing to the returning officer, in the place and stead of the Leader of the Official Opposition or his delegate.
Furthermore, in the electoral divisions of Abitibi-Est, Abitibi-Ouest, Duplessis and Saguenay, more than one delegate may be designated in writing to the returning officer, provided that the territory assigned to each of them is clearly defined.
(2)  On the same day, the returning officer shall appoint, in form 27, an enumerator to draw up the list for each rural polling subdivision.
(3)  If, within the delay prescribed in subsection 1, the returning officer receives no written recommendation or if the person recommended as enumerator is not qualified for such office, the returning officer must make the appointment, without awaiting a written recommendation or without taking account of one made to him, as the case may be.
(4)  At a by-election during which an enumeration is made, the written recommendation and the appointment of enumerators provided for in subsection 1 must be made by the same persons on Thursday of the sixth week preceding that of the polling.

At general elections contemplated in the third paragraph of section 454 of this act, the written recommendation and the appointment of the enumerators provided for in the first paragraph must be made by the same persons on Thursday of the sixth week preceding that of the polling. However, any candidate who was a member of the opposition but not of the Official Opposition or who was sitting as an independent, having been elected as such, at dissolution of the Assemblée nationale, and any delegate designated by him in writing to the returning-officer, may make a recommendation in writing to the latter, of the enumerators in the electoral district where he is a candidate, in the place and stead of the Leader of the Official Opposition or his delegate.
(2)  On the same day, the returning-officer shall appoint, in form 27, an enumerator to draw up the list for each rural polling-subdivision.
