410. (1)  Except in the cases provided in section 143, every person who votes, attempts to vote or induces or procures any person to vote at an election, knowing that he or such person is not entitled to vote thereat, shall be guilty of an unlawful act and liable to a fine of one hundred to five hundred dollars and to an imprisonment of six months to two years and, on failure to pay the fine, to an additional imprisonment of three months to one year.
(2)  In any prosecution under this section, the burden shall be upon the defendant to prove that such person was entitled to vote at the election and not upon the prosecutor to prove that he was not so entitled.
