342. (1)  At the time and place appointed by the judge of the Court of Appeal or at any other time and place to which the hearing may be adjourned, such judge or another judge of the same court, after hearing such of the parties as are present or their counsel, shall make such order as the facts seem to him to warrant, either dismissing the petition or enjoining the judge in default to comply with the provisions of this division and to make and complete the recount or re-addition, as the case may be.
(2)  The judge of the Court of Appeal may also make such order as to costs as he thinks proper.
