340. (1)  If it appears that such omission, refusal or neglect has occurred, the judge of the Court of Appeal shall make an order appointing one of the next eight days, and a place, for the consideration of the petition, and directing the attendance of all parties interested at such time and place, and giving such directions as he thinks proper for the serving of the order and of the affidavits upon which the order was founded, upon the judge complained of and upon the parties interested.
(2)  If the circumstances appear to the judge to warrant it, he may direct that service upon the interested parties may be made upon their attorneys, or by mail, or in such other manner as he thinks fit.
