36. Every person who keeps or operates any other place of amusement, without a license to that effect, still in force as by law prescribed, shall be guilty of an offence under this division and shall be liable, in addition to the payment of the costs: for a first offence, to a fine equal to twice the amount of the license duty, and, on failure to pay the said fine and costs, to imprisonment for not more than three months; and for every subsequent offence, to imprisonment for not more than three months without the option of a fine.
