I-8.1 - Act respecting offences relating to alcoholic beverages

83. Subject to section 82.1, paragraphs i and j of section 91 and to the right of the holder of a permit issued under the Act respecting the Société des alcools du Québec (chapter S-13) to have alcoholic beverages in his possession for purposes authorized by his permit, possession or keeping of the following is forbidden:
(1)  wines other than those determined by regulation under paragraph 7 of section 37 of the Act respecting the Société des alcools du Québec, and alcohol and spirits not purchased directly from the Corporation, from a person authorized by it or from a distiller’s permit holder;
(2)  wines or alcoholic beverages determined by regulation under paragraph 7 of section 37 of the Act respecting the Société des alcools du Québec, not purchased directly from the Corporation, from a person authorized by it or from a grocery permit holder;
(3)  weak cider not purchased directly from the Corporation, a person authorized by it or a grocery permit or cider seller’s permit holder;
(4)  cider other than weak cider not purchased directly from the Corporation, a person authorized by it, or a grocery permit or cider seller’s permit holder;
(4.1)  beer not purchased directly from the Corporation, from a person authorized by it or from a grocery permit or brewer’s permit holder;
(5)  alcoholic beverages made by the holder of a small-scale production permit issued under the Act respecting the Société des alcools du Québec, not purchased directly from the Corporation, from the small-scale production permit holder or from a grocery permit holder;
(6)  beer, made by the holder of a small-scale beer producer’s permit issued under the Act respecting the Société des alcools du Québec, not purchased directly from the permit holder, from the Corporation or from a grocery permit holder.

83. (6)  beer, made by the holder of a small-scale beer producer’s permit issued under the Act respecting the Société des alcools du Québec, not purchased directly from the permit holder or from the Corporation.

(1)  wines other than those determined by regulation under paragraph 7 of section 37 of the Act respecting the Société des alcools du Québec, alcohol or spirits not purchased directly from the Corporation or a person authorized by it;
(2)  wines or alcoholic beverages determined by regulation under paragraph 7 of section 37 of the Act respecting the Société des alcools du Québec, not purchased directly from the Corporation, from a person authorized by it or from a grocery permit holder;
(3)  weak cider not purchased directly from the Corporation, a person authorized by it, a cider maker’s permit holder or his agent, or a grocery permit or cider seller’s permit holder;
(4)  cider other than weak cider not purchased directly from the Corporation, a person authorized by it, or a grocery permit or cider seller’s permit holder.

83. In all cases where the sale or possession is permitted, the alcohol, spirits and wine sold or possessed must have been purchased directly from the Corporation by the person selling or possessing them.
In all cases where the sale or possession of strong cider is permitted, the strong cider sold or possessed must have been purchased by the person selling or possessing it, directly from the Corporation, the holder of a strong cider maker’s permit issued under the Act respecting the Société des alcools du Québec, the holder of a cider seller’s permit or the holder of a grocery permit.
