I-8.1 - Act respecting offences relating to alcoholic beverages

34. To obtain a permit, the applicant must, in addition to complying with the other requirements of this act:
(a)  be a Canadian citizen or, in the case of a person domiciled in Québec who has resided therein for at least one year, undertake to apply for Canadian citizenship as soon as he may do so under the Canadian Citizenship Act (Statutes of Canada);
(b)  have attained the full age of twenty-one years;
(c)  never have been convicted of a criminal offence punishable upon indictment;
(d)  offer guarantees deemed sufficient that he will comply with the law and the regulations;
(e)  be solvent and, if he is not acting on his own behalf, act for a corporation, an association of apple-growers, a partnership or a club that is solvent;
(f)  produce the permit required by any act regulating the hotel business in Québec;
(g)  indicate the place where the establishment is situated and identify the rooms of such establishment where the permit is to be used; show that the establishment and the rooms where the permit is to be used are equipped suitably and in accordance with the requirements of this act and the regulations made thereunder;
(h)  prove that he is the owner or lessee of the establishment where the permit is to be used, or that he is specially authorized by the owner or lessee of such establishment to apply for the permit and, if it is granted to him, to use it on his own behalf in the rooms of the establishment designated in his application;
(i)  apply therefor in writing to the Commission in accordance with the regulations made under section 12;
(j)  in the case of an applicant acting for a corporation, a cooperative syndicate or association, an apple-growers’ association, a partnership or a club, be authorized in writing and give proof of his mandate;
(k)  in the case of an applicant acting for a corporation or club, provide the names and addresses of the directors of such corporation or club, and in the case of an applicant acting for an association, partnership or association of apple-growers, provide the names and addresses of the members of such association, partnership or association of apple-growers;
(l)  in all cases where the applicant must, by law, obtain a municipal permit, produce such permit;
(m)  produce any document the Commission may require within the delays fixed by the regulations made under section 12;
(n)  furnish his social insurance number.
The Commission may, notwithstanding subparagraph c of this section, grant a permit to an applicant who, pursuant to a conviction contemplated in the said subparagraph, has five years previously to the date of his application, completed his sentence or, as the case may be, his probation, or paid his fine, provided that he gives every guarantee the Commission considers sufficient that he will observe the law and the regulations.
