I-13.01 - Act respecting electrical installations

31. Every person is guilty of an offence who
(a)  makes a false statement when applying for a licence or when applying for a connection;
(b)  hinders or molests an inspector or other functionary discharging his office;
(c)  does electrical installation work without holding a licence;
(d)  has not renewed his licence in conformity with section 23;
(e)  has not paid the fees determined under the Act or the regulations;
(f)  infringes a prescription of this Act or of any regulation hereunder.

(b)  hinders or molests an inspector or other functionary discharging his office;
(c)  does electrical installation work without holding a licence or a permit;
(d)  has not renewed his licence in conformity with section 23;
(e)  has not paid the fees determined under the act or the regulations;
(f)  infringes a prescription of this act or of any regulation hereunder.

31. Every person is guilty of an offence who

31. The following shall be liable, for a first offence, in addition to the costs, to a minimum fine of ten dollars per day and a maximum fine of fifty dollars per day, or to imprisonment for eight days, or to both fine and imprisonment at the discretion of the court, and, for the second or any subsequent offence, in addition to the costs, to a fine of fifty dollars per day or to one month’s imprisonment, or to both fine and imprisonment at the discretion of the court:
(1)  Every company, association, corporation or person who or which:
(a)  Does business or contracts for or does electrical installation work without being the holder of the license required by this act;
(b)  Neglects or refuses to submit, for the approval of the board of examiners, the plans for a proposed electrical installation in a building covered by section 3 of this act, as well as those for installing a heating system, or who begins installation work before obtaining approval of the plans;
(c)  Begins or allows electrical installation work to be begun without having previously obtained the permit required by section 4 of this act;
(d)  Offers for sale, sells or utilizes, in electrical installations, materials, accessories or apparatus, other than those prescribed according to section 10 of this act;
(2)  Every company, association, corporation or person who or which:
(a)  Neglects or refuses to pay the fees exigible under reserve, however, of the recourse contemplated by section 37, which may be exercised independently of the prosecution for infringement of this sub-paragraph;
(b)  Connects an electrical installation contrary to the provisions of section 6 of this act;
(c)  Neglects or refuses to sever the connection with an electrical installation, as provided in section 9 of this act;
(d)  Collects fees contrary to the provisions of subsection 4 of section 25 of this act; and
(e)  Neglects to post up the permit, as provided by section 4.
(3)  Every person who hinders, molests or embarrasses an inspector or any other officer or employee, or who interferes in the performance of his duties.
