532. Only the employees whose names appear in the transfer plan of the new school board on 28 February 1986 may participate in the vote by secret ballot.
In case of a disagreement owing to the fact that the persons actually comprised in a bargaining unit on 1 July 1986 are not the persons whose names are on the transfer plan on 28 February 1986, any association qualified for certification or the new school board may file a petition with the labour commissioner general requesting him to decide the matter. No such petition shall prevent the association from being certified.
Where the labour commissioner to whom the matter has been referred decides that allowing the petition might affect the result of the voting, he shall declare that there is such a disagreement and order, if necessary, a new vote by secret ballot.
Where certification is granted to another association, the only collective agreement applicable from the date of final judgment is the collective agreement in force on 30 June 1986 and to which the association being certified in conformity with this section was a party.
