E-2.2 - Act respecting elections and referendums in municipalities

312.4. The provisional incapacity ceases on the first of the following dates:
(1)  the date on which the prosecutor stays or withdraws all charges in the proceedings on which the application was based;
(2)  the date of a judgment of acquittal or a stay of proceedings in respect of all such charges;
(2.1)  the date on which the elector, Attorney General, Commission municipale du Québec or municipality discontinues the action for declaration of disqualification on which the application was based;
(2.2)  the date of the judgment, having become a res judicata, dismissing the action for declaration of disqualification; and
(3)  the date on which the council member’s term that was in progress on the date of the judgment ends in accordance with the provisions of this Act.
