44. (Repealed).

44. No executor, trustee or administrator is personally liable for the payment of the duties; nevertheless, he may be required to pay these duties out of the property or money in his possession belonging or owing to the beneficiaries, and, if he fails to do so, he may be sued for the amount of these duties, but only in his representative capacity, and any judgment rendered against him in that capacity shall be executed against that property or money only.
