38. The Association may institute penal proceedings in view of imposing a sanction for an offence under any provision of this Act.

38. The fines provided by this Act may be claimed by ordinary civil action in the name of the Association before the Superior Court or the Court of Québec, as the case may be, according to the amount and the number of the fines claimed.
Proceedings so taken shall be heard and decided by preference in accordance with the provisions of the Code of Civil Procedure.
No security shall be exigible from the Association.
