87. Every person who lays or causes to be laid any pipe or main which communicates with any pipe or main belonging to a company, or uses gas or water without the consent of the company is liable to a fine of $120 and, in addition, to a fine of $4 for each day during which such communication remains.

87. If any person lays or causes to be laid any pipe or main to communicate with any pipe or main belonging to any such company, or in any way obtains or uses its gas, or water, without the consent of the company, he shall forfeit and pay to the company the sum of $120, and also a further sum of $4, for each day during which such communication remains, which sums, together with costs of suit, may be recovered by civil action in any court of competent jurisdiction.
