338. (Repealed).

338. Where the addition of the votes gives the same number of votes to more than one candidate and one additional vote to any candidate would give him the right to be declared elected, the presiding officer shall immediately declare in writing that there is a tie. A recount of the votes must then be made in accordance with article 387.
