104. Notwithstanding subsection 8 of section 96, a municipality may, under an agreement with the Attorney General approved by the Government, waive, in favour of the Attorney General, the prosecution of any offence committed on its territory against the laws, regulations and by-laws respecting traffic and parking, and agree on the sharing of fines.
As soon as any agreement contemplated in the first paragraph is published in the Gazette officielle du Québec, the Attorney General has the requisite power to prosecute for the offences contemplated therein, and section 98 applies; in addition, the Minister of Finance then has sufficient authority to pay to the municipality concerned its share of the proceeds of the fines out of the consolidated revenue fund, to such extent as they have been paid into it.
