393. No driver of a motorcycle or moped may carry any other person on the vehicle unless it is equipped with permanently fixed seats designed for that purpose and with foot-rests fixed on each side of the vehicle; when the vehicle is moving, a passenger must be seated facing the handlebars and with both feet on the foot-rests.
