385. The board shall be composed of members, some of whom shall be commissioners.
The Commissioners shall be advocates or notaries. They shall be appointed by the Government after consultation with the Comité consultatif du travail et de la main-d’oeuvre established under section 12.1 of the Act respecting the Ministère du Travail (chapter M-32.2).
The members other than the commissioners shall be either from employers’ associations or from union associations.
The members from employers’ associations shall be appointed by the Government from among the persons whose names appear on a list drawn up annually by the board of directors of the Commission for each region in which the board has an office.
The members from union associations shall be appointed by the Government from among the persons whose names appear on a list drawn up annually by the said board of directors for each region in which the board has an office.
The Minister may draw up a list under the fourth or fifth paragraph if the board of directors of the Commission has failed to do so.

385. Two thirds of the commissioners appointed pursuant to section 368 shall at a meeting called for that purpose by the president adopt a code of ethics for commissioners and assessors.
The board of appeal shall publish a draft of the code of ethics it wishes to adopt in the Gazette officielle du Québec with a notice that on the expiry of 60 days from the notice it will be adopted with or without amendment by the board of appeal and submitted to the Government for approval.
The code comes into force ten days after the date of publication in the Gazette officielle du Québec of the order approving it or, if it has been amended by the board of appeal or the Government, of the order and the final text of the code, or on any later date fixed in the order.
