A-23.001 - Act respecting arrangements for funeral services and sepultures

40. The president of the Office de la protection du consommateur may appoint a provisional administrator to manage temporarily, continue or terminate the current business of a seller, in either of the following cases:
(1)  where the seller operates without holding a funeral services business licence or where the licence is cancelled, suspended or has not been renewed and where, in consequence thereof, the seller is or becomes disqualified to fulfil his obligations under the contracts entered into by him;
(2)  where the seller is bankrupt, assigns his property, becomes insolvent or ceases to operate.
Sections 260.17 and 260.19 of the Consumer Protection Act (chapter P-40.1), adapted as required, apply to such an appointment.
