34. Except in the case of a subsequent conviction, no penal proceedings may be instituted pursuant to this Act or the regulations hereunder unless the inspector has mailed to the offender a previous notice describing the offence and specifying the minimum fine, the amount of the costs and the place where payment must be made within ten days following the notice.
Payment of the amount required within the time fixed by the notice precludes penal proceedings.
After payment, the offender is considered to have been convicted of the offence.
However, payment cannot be invoked as an admission of civil liability.
