Regulation respecting the filing of an arbitration award and the information concerning the duration of arbitration procedures

DIVISION I
FILING OF AN ARBITRATION AWARD
1. The Minister shall forward to the disputes arbitrator or to the grievances arbitrator, as the case may be, an attestation showing the date of reception of an arbitration award filed in accordance with section 89 and 101.6 of the Labour Code (chapter C-27). A similar attestation may be forwarded to any interested party who makes a written request.

INFORMATION TO BE GIVEN BY THE GRIEVANCES ARBITRATOR

2. The grievances arbitrator must, at the same time as he files an arbitration award under section 101.6 of the Labour Code (chapter C-27), make a written declaration in accordance with section 3.

3. The declaration in section 2 must contain the following particulars:
(a)  the name and address of the grievances arbitrator and, as the case may be, of his accessors;
(b)  the manner and date of appointment of the grievances arbitrator;
(c)  mention of the section of the Labour Code (chapter C-27) in virtue of which the grievances arbitrator intervened;
(d)  the nature of the grievance and the date it was filed;
(e)  the name and address of the employee’s association and the employer’s association;
(f)  the sector in which the enterprise carries out its activities;
(g)  the date of the award or withdrawal of the grievance and the date of the report by the grievances arbitrator of the said award or withdrawal before the beginning of the inquiry;
(h)  the hearing dates;
(i)  the date of receipt of the factums of the parties, as the case may be;
(j)  the date of sittings if the grievances arbitrator is assisted by one or two assessors;
(k)  the date the award was rendered;
(l)  the date the award was sent to be filed.
