Regulation respecting the application of the Act respecting health services and social services for Cree Native persons
Act respecting health services and social services for Cree Native persons
(chapter S-5, s. 173).
In accordance with section 619.41 of the Act respecting health services and social services (chapter S-4.2) and subject to any special provisions enacted by that Act, the provisions of this Regulation remain applicable to the persons and bodies subject to that Act to the extent that the measure or provision is compatible with that Act and until such time as the Government makes a corresponding regulation under that Act.

DIVISION VI
STATUS OF RESIDENT OF QUÉBEC FOR FINANCING PURPOSES
336. For purposes of financing of an institution, other than a reception centre, the Minister or the Government shall only consider beneficiaries who have the status of resident of Québec.

337. For the purposes of this Division, unless the context indicates otherwise
(a)  “landed immigrant” means a non-Canadian who takes up residence in Canada and who has a permanent visa permitting him to do so;
(b)  “repatriated Canadian” means an indigent Canadian citizen who is brought back to Canada from a foreign country at the expense of the State after he has ceased to be eligible for coverage by the hospital insurance plan in his province of origin;
(c)  “Canadian returning to the country” means a Canadian citizen who takes up residence in Canada again after he has ceased to be eligible for coverage by the hospital insurance plan in his province of origin;
(d)  “landed immigrant returning to the country” means a landed immigrant who takes up residence in Canada again after he has ceased to be eligible for coverage by the hospital insurance plan in his province of origin;
(e)  “province of origin” means the last province in which a person was eligible for coverage by the hospital insurance plan;
(f)  “dependent” means the spouse and every minor child permanently residing with the person who has status of resident.

338. Residence is established on the basis of physical presence without regard to intention.
The status of resident is acquired by birth in Québec of a mother already having the status of resident of Québec.
However, a person who is:
(a)  a landed immigrant;
(b)  a repatriated Canadian;
(c)  a Canadian returning to the country;
(d)  a landed immigrant returning to the country;
(e)  a Canadian citizen or his spouse who takes up residence in Canada for the first time;
(f)  a member of the Canadian Armed Forces or of the Royal Canadian Mounted Police who has not acquired the status of resident of Québec;
(g)  a prisoner who has not acquired the status of resident of Québec at the time of his incarceration in Québec;
as well as each of his dependents shall be deemed, after having resided for 3 months in Québec following his arrival, discharge or liberation, as the case may be, to be a resident of Québec.

339. For the purposes of this Division, when a child is born outside Québec of a mother having the status of resident of Québec, he shall be deemed to be a resident of Québec.

340. The status of resident, once it has been acquired, is retroactive to the first day of the period of residence.
However, there shall be no retroactivity where a person who arrives in Québec had previous residence elsewhere in Canada. In such case, the status of resident of Québec is acquired with effect from the first day of the third month following the month of arrival.
Students from another province shall not be considered residents of Québec unless they prove that they have lost their eligibility as residents of their province of origin.

341. A person having the status of resident and all his dependents shall retain the status of resident in the following cases:
(a)  if he stays outside Québec as a Québec student registered in an educational institution outside Québec and pursuing a study programme therein;
(b)  if he stays outside Québec as a full-time trainee and without remuneration in a university, an institution affiliated with a university, a research institute or a government or international body;
(c)  if he is a civil servant employed by the Gouvernement du Québec in service outside Québec;
(d)  if he was admitted to a hospital outside Québec before the expiry of a period of 3 months following his departure. The calculation of the period required for loss of resident status is suspended for the duration of such hospitalization. However, this suspension shall cease if the person fails to forward to the Minister, every 30 days, a medical certificate attesting to the impossibility of his returning to Québec;
(e)  if he was absent from Québec for less than 12 consecutive months, while his family still resided or maintained a dwelling therein, in order to undertake temporary employment or execute a contract in another province or country, and he returns to Québec at least once a year or he informs the Minister of his inability to comply with this requirement;
(f)  if he is employed by a non-profit organization having its head office in Canada, and if he works abroad within the framework of an international aid or co-operation programme approved by the Minister of Health and Social Services.

342. Notwithstanding section 338, a foreign national as well as any of his dependents may acquire the status of resident during his stay in Québec and for the services he receives therein:
(a)  if he stays in Québec under an exchange programme approved by the Gouvernement du Québec and a foreign government, following an agreement between the Minister of Health and Social Services and the Minister of Immigration, Francization and Integration;
(b)  if he holds an employment visa issued by the Federal Department of Citizenship, Immigration and Multiculturalism and if he stays in Québec in order to hold an office or employment therein for a period of more than one year.

343. A person shall lose the status of resident:
(a)  when he leaves Québec to take up residence in another province, with effect from the first day of the third month following the month of arrival in that other province;
(b)  if he maintains a residence outside Québec, unless he proves that he resides and is customarily present in Québec at least 183 days annually;
(c)  if he is absent from Québec for more than 12 months.
The loss of residence takes effect immediately after any one of these conditions is met.

344. Where a person who had the status of resident of Québec has left Québec for a period of more than 3 months but less than 12 months, the Minister shall refuse to reimburse the cost of services received if that person has taken up his residence outside Québec during such period.

345. Notwithstanding the foregoing, the period of stay in an establishment contemplated in this Division is not computed in calculating the time limit for obtaining the status of resident of Québec.

346. An institution shall not require from beneficiaries, for accommodation or services to a person accommodated, in respect of which it receives financing out of the appropriations voted by the National Assembly, any rate or charge other than those prescribed in this Regulation, in the Youth Protection Act (chapter P-34.1) in the Hospital Insurance Act (chapter A-28) or in the Regulation made under this Act.

§ 2.  — Contribution of adults accommodated
357.3. For the purposes of this Subdivision:
dependent child is understood as:
(1)  a person under age 18 in respect of whom the accommodated adult exercises parental authority;
(2)  a spouseless person 25 years of age or under who attends or is deemed to attend an educational institution on a full-time basis as a duly registered student, and who is domiciled with the accommodated adult who would exercise parental authority were the person a minor;
educational institution : an educational institution located in Canada designated by the Minister of Education, Recreation and Sports or the Minister of Higher Education, Research, Science and Technology for the application of the Loans and bursaries program established under the Act respecting financial assistance for education expenses (chapter A-13.3).

358. A reception centre or a hospital centre in which an adult is accommodated shall require from the latter a per diem contribution for his accommodation, calculated under this Subdivision.

358.1. The per diem is payable from the first day an adult is accommodated:
(a)  in a homecare centre, a hospital centre for long-term care or an institution offering such services;
(b)  in a rehabilitation centre for the physically handicapped or a rehabilitation centre for the mentally handicapped;
(c)  in a rehabilitation centre for the socially handicapped or a rehabilitation centre for mothers with adaptation problems where the beneficiary has reached the age of 18;
(d)  in a hospital centre for short-term care where a beneficiary has been discharged under section 4 of the Act but his condition does not allow his return home and a place must be found for him in an institution described in paragraph a, b or c of this section.

358.2. The per diem is payable after an adult has been accommodated for 45 days:
(a)  in a rehabilitation centre for drug addicts; and
(b)  in a hospital centre for short-term care, except where the attending physician or a specialized nurse practitioner certifies in the beneficiary’s medical record that active care is still required because of a particular pathology and repeats his certificate every 30 days thereafter.

359. The daily rate payable to a reception centre shall be equal to the estimated operating cost of the centre including the depreciation of capital assets, the cost of medication and the cost of nursing services, divided by the probable annual number of days of stay. The cost of external services, however, shall not be considered in determining the rate.

360. The per diem payable to a hospital centre for an adult who is a Québec resident shall be $69.33 for a private room, $57.92 for a semi-private room and $43.15 in every other case.
The amounts referred to in the first paragraph are indexed on 1 January each year according to the Pension Index established pursuant to section 117 of the Act respecting the Québec Pension Plan (chapter R-9).
For the purposes of this Subdivision, a “Québec resident” is understood as a person who is residing in Québec or who is residing in Québec temporarily within the meaning of sections 5 to 8 of the Health Insurance Act (chapter A-29).

360.1. Notwithstanding anything to the contrary in this Subdivision, the following persons must pay, from the first day, the per diem published by the Minister and determined on the basis of estimates of expenses and income, taking into account the days of stay for the period in question:
(a)  an adult accommodated in a hospital centre who is not a Québec resident;
(b)  an adult who, under section 4 of the Act, has been discharged and whose condition allows his return home or for whom a place is assured in another institution but who refuses to leave the institution accommodating him; and
(c)  a third party responsible for damages necessitating the accommodation of an adult or whose duty, under a statute of Québec, Canada or any other jurisdiction, is to be responsible for the cost of services provided to an accommodated adult.

361. The daily rate is invoiced every month, before the beginning of the month, at 30 times its amount, to fix the monthly rate payable by the adult. If the accommodation period is less than 30 days, the rate shall be invoiced pro rata to the days of stay which remain.
The day from which the contribution is or becomes payable is considered a day of stay but that on which the beneficiary leaves is not counted. Periods of temporary discharge from a hospital centre or a reception centre are counted as days of stay.

362. An adult whose contribution income less income tax is less than the monthly rate which he has to pay shall benefit from an exemption from payment equal to the difference between such rate and such income.

363. The contribution income is calculated according to the following formula:
Where: Contribution income = (A + B) - C
A = Family income established in keeping with the provisions of section 363.1;
B = Increase for property established in keeping with the provisions of section 363.2;
C = Sum of the deductions granted in keeping with the provisions of section 363.3.
Where the result is negative, the income contribution is nil.
Notwithstanding the provisions of sections 363.1 to 363.3, the following factors must not be taken into consideration for the purpose of establishing the contribution income:
(1)  the presence of a spouse or a child with respect to whom a contribution may be required pursuant to section 159 of the Act or section 512 of the Act respecting health services and social services (chapter S-4.2) as a beneficiary or user who is accommodated in an institution referred to in one of these statutes or who is taken in charge by a resource referred to one of these statutes;
(2)  the benefit to an adult consisting in relief in whole or in part from payment for his accommodation;
(3)  the amount of the benefit received under a financial assistance program provided for in Chapter I, II, V or VI of Title II of the Individual and Family Assistance Act (chapter A-13.1.1) as well as the interest produced by the liquid assets of the accommodated adult and his spouse, if applicable, whose value does not exceed the exclusion amounts set out in the first paragraph of section 369;
(4)  the expenses incurred to maintain a dwelling or residence;
(5)  the payments referred to in paragraph 29 of section 111 of the Individual and Family Assistance Regulation (chapter A-13.1.1, r. 1), up to the maximum amount set out therein.

363.1. Family income includes the income of the adult and that of his spouse, if applicable, for the preceding month, within the meaning of section 28 of the Taxation Act (chapter I-3), as well as any non-taxable indemnity, pension, annuity, allowance or benefit arising from any source whatsoever other than for the exclusive advantage of a dependent child, an informal caregiver, or received to compensate for a disability.

363.2. The increase for property is equal to 1% of the amount by which the value of the property of the accommodated person and his spouse, if applicable, exceeds $5,000 if the accommodated adult has a dependent spouse or child, and $2,500, in all other cases.
For the purpose of calculating this increase, the total value of the property is determined in accordance with sections 145, 146, 148 and 150 of the Individual and Family Assistance Regulation (chapter A-13.1.1, r. 1), given the necessary adaptations and excluding the total value of the following property from the calculation of the increase:
(1)  the value of a residence or farm during the longer of the following periods:
(a)  a period of one year from the time when a contribution may be required of the adult pursuant to section 159 of the Act, as a beneficiary who is accommodated in an institution;
(b)  the period during which the dependent spouse or child of the accommodated adult lives in or operates this residence or farm on a continuous basis;
(2)  the capital from an indemnity paid as compensation for immovable property following an expropriation, fire or other disaster, act of war, attack or criminal act if it is used in the 2 years following its receipt for the repair or replacement of this property or for the operation of an enterprise;
(3)  the capital from the sale of a residence if it is used to purchase a new one or have a new one built within 6 months of the sale;
(4)  the capital from an indemnity paid as compensation for movable property following a fire or other disaster, act of war, attack or criminal act if it is used within 90 days of its receipt;
(5)  the value of the property used within the scope of self-employment or the operation of a farm.
Notwithstanding the first paragraph, with respect to the property referred to in subparagraphs 1 to 3 of the second paragraph, the increase for property applicable at the end of the time periods set out therein is equal to 1% of the amount by which the total value of the property exceeds the amount provided for in the first paragraph of section 164 of the Individual and Family Assistance Regulation.

363.3. The following monthly deductions are granted to an accommodated adult in the cases and conditions indicated:
(1)  $1,299 where the accommodated adult has a spouse;
(2)  $520 for each dependent child under age 18;
(3)  $652 for each dependent child age 18 or over;
(4)  $300 as a personal expense allowance, where the deduction set out in subparagraph 1 is not granted to the accommodated adult;
(5)  a deduction for the payment of the rent indicated in the lease of the dwelling that the accommodated adult was occupying before his admission to an institution and which he is required to fulfil, up to the portion of the monthly lease assumed by this adult. For the purposes of determining the rent that the adult is required to pay, services other than those referred to in the provisions of the third paragraph of section 1974 of the Civil Code are not taken into consideration. This deduction may be granted only for the first two contribution months on presentation of documents establishing the obligation to continue paying rent and the amount to be paid.
The amounts referred to in subparagraphs 1 to 4 of the first paragraph are indexed on 1 January of each year on the basis of the Pension Index established in accordance with section 117 of the Act respecting the Québec Pension Plan (chapter R-9). They are rounded to the nearest dollar.

364. The contribution income less income tax represents the amount obtained after having deducted from the contribution income determined in conformity with section 363 the amount of income tax which the adult and his spouse not accommodated would have to pay if they were paying such tax on a monthly basis.

365. The adult who must pay a monthly rate may, in addition to the exemption he benefits from under section 362, be granted a supplementary exemption if he is in one of the situations referred to in section 366 or 368.

366. The Minister shall grant a supplementary exemption to the adult who does not benefit from any of the deductions referred to in subparagraphs 1, 2 and 3 of the first paragraph of section 363.3 if his contribution income is less than twice the monthly rate that he has to pay.
The exemption referred to in the first paragraph is then equal to the difference between the amount which the adult would be exempt from paying, in accordance with section 362, if he only had to pay one-half of his contribution income as monthly rate, and the amount for which he is actually benefiting from an exemption under this section.

367. For the purposes of section 366, the contribution income of an adult who draws any benefit under the Old Age Security Act (R.S.C. 1985, c. O-9) is determined by adding the amount by which the maximum benefit payable under the Act exceeds the personal expense allowance prescribed in subparagraph 4 of the first paragraph of section 363.3.

368. The Minister shall grant a supplementary exemption to the adult who benefits from one of the deductions referred to in subparagraphs 1, 2 and 3 of the first paragraph of section 363.3 if his contribution income is less than four times the monthly rate that he has to pay.
The exemption referred to in the first paragraph is then equal to the difference between the amount which the adult would be exempt from paying, in accordance with section 362, if he only had to pay 1/4 of his contribution income as monthly rate, and the amount for which he is actually benefiting from an exemption under this section.

369. The amount of the exemption granted to an accommodated adult is reduced by the amount by which the value of his liquid assets and those of his spouse, if applicable, exceed $5,000, if the accommodated adult has a dependent spouse or child, and $2,500, in all other cases.
Subject to section 369.1, the total value of the liquid assets is determined in accordance with sections 128 and 129 of the Individual and Family Assistance Regulation (chapter A-13.1.1, r. 1), taking into consideration the necessary adaptations.
Notwithstanding the first paragraph, in the case of an adult whose accommodation predates 1 July 1975, the amount by which the value of his liquid assets and those of his spouse, if applicable, exceeds the exclusion amounts referred to therein is added instead to the value of his property for the purposes of the provisions of section 363.2.

(2)  the sums accrued in a registered retirement savings plan, where the holder of the plan has not reached the age of eligibility for a full pension under the Old Age Security Act (R.S.C. 1985, c. O-9);
(3)  the sums accrued in a registered disability savings plan, including those paid into it in the form of Canada disability savings bonds or Canada disability savings grants for the benefit of the adult, his spouse or one of his dependent children and which he cannot dispose of in the short term without incurring a penalty, according to the rules applicable to that plan;
(4)  the cash surrender value of a life insurance policy.
The exclusions set out in subparagraph 1 of the first paragraph apply as of the date of payment of these sums and only for the person who is entitled thereto.

371. The Minister shall grant, upon application of the adult accommodated in a reception centre, regardless of section 369 and the increase for property referred to in section 363.2, a supplementary exemption equal to the difference between the monthly rate payable to the reception centre less the exemption and the monthly rate that he would pay if he were accommodated in a hospital centre.

372. The Minister shall, upon application, grant to an adult accommodated in a private institution contemplated in section 176 of the Act, regardless of section 369 and the increase for property referred to in section 363.2, an additional exemption equal to the difference between the monthly rate payable under section 371 and the monthly amount which the institution is entitled to receive for accommodating that adult.
The Minister shall upon request grant to an adult accommodated in a pavilion of a homecare centre, regardless of section 369 and the increase for property referred to in section 363.2, an additional exemption equal to the difference between the monthly rate payable under section 371 and, up to an amount of $715.50 for a bed in a ward and $863.70 for a private room or semi-private room, the monthly amount which the pavilion is entitled to receive for accommodating that adult.
The amounts $715.50 and $863.70 referred to in the second paragraph shall, from 1 January 1998, be indexed at the beginning of each year according to the Pension Index established in accordance with section 117 of the Act respecting the Québec Pension Plan (chapter R-9).

373. The adult exempt from paying the rate of accommodation the duration of which is less than 30 days shall only be exempted on the basis of his days of stay, by correcting according to such basis the amount which he would be exempt from paying for 30 days.

374. An application for exemption must be addressed to the Minister using the appropriate form supplied to this end. The adult who files an application for exemption must transmit all information and documents necessary to process this application, including the documents necessary to establish the adult’s income and, if applicable, that of his spouse, as well as the total value of their property and liquid assets.
An exemption may be granted retroactively only up to six months preceding the receipt of the application for exemption by the Minister. However, the Minister may extend this time limit where it was impossible for the adult to file an application sooner.
The adult must notify the Minister of any change regarding the information or documents transmitted in support of an application for exemption within 30 days of such a change.

§ 3.  — Contributions of adults placed in a foster family
376. Where an adult under 65 years of age is placed in a foster family, his monthly contribution shall be equal to the scale of needs applicable to an independent adult under the financial support program referred to in the Regulation respecting income security (O.C. 922-89, 89-06-14), less the personal expense allowance prescribed in subparagraph 4 of the first paragraph of section 363.3.
Notwithstanding the foregoing, where the adult receives benefits under the work and employment incentives program of the Act respecting income security (chapter S-3.1.1), his monthly contribution shall be equal to the scale of needs based on unavailability prescribed in that program and applicable to an independent adult, less the personal expense allowance prescribed in subparagraph 4 of the first paragraph of section 363.3.
Notwithstanding the second paragraph, where the benefits that an adult under 65 years of age receives under the work and employment incentives program of the Act respecting income security are less than the scale of needs based on unavailability prescribed in that program and applicable to an independent adult, the monthly contribution of that adult shall be equal to the scale of needs applicable to the category in which that adult is registered in the program and applicable to an independent adult, less the personal expense allowance prescribed in subparagraph 4 of the first paragraph of section 363.3.

(2) a declaration made to the House of Commons on 14 December 1989 by the Minister of Health and Welfare Canada regarding persons infected by the human immunodeficiency virus following a blood transfusion or use of blood-derived products;
(3) the creation of a humanitarian fund by the Government of Québec for hemophiliacs and other persons infected by the human immunodeficiency virus following a blood transfusion, unless the amounts are paid as compensation for loss of income or loss of support;
(4) the creation of the extraordinary assistance plan by the Government of Canada for victims of thalidomide (Order in Council P.C. 2019-0271 dated 5 April 2019);
(5) the creation of a Government of Canada program respecting ex gratia payments to persons depatterned at the Allan Memorial Institute between 1950 and 1965 (Order in Council P.C. 1992-2302 dated 16 November 1992);

(16) recommendations in the report drawn up following the mandate given by the Government of Québec under Recommandation du Curateur public de mesures appropriées pour évaluer les pertes financières causées aux personnes représentées et les réparer (Order in Council 931-98, 8 July 1998), regarding damage suffered by certain persons represented by the Public Curator;
(17) the Court of Appeal of Québec judgment in Centre d’accueil Pavillon Saint-Théophile Inc. v. the Commission des droits de la personne, rendered on 21 September 1998;
(18) the Nova Scotia Memorandum of Understanding regarding Compensation for Survivors of Institutional Abuse regarding damage suffered by certain residents of provincially-operated institutions;
(19) the Superior Court judgment rendered on 14 September 2001 confirming the agreement with the Canadian Red Cross Society following the class action brought by persons who received a blood transfusion contaminated by the hepatitis C virus and who were infected by the virus before 1 January 1986 or between 1 July 1990 and 28 September 1998;
