Guidelines respecting odours caused by manure from agricultural activities
Act respecting the preservation of agricultural land and agricultural activities
(chapter P-41.1) .
1. OBJECT AND SCOPE
The following provisions pertain only to odours caused by agricultural practices. The provisions do not operate to exempt agricultural operations from the requirement to respect the environmental standards contained in specific regulations of the Ministère du Développement durable, de l’Environnement et des Parcs. Their purpose is to establish a procedure for determining separation distances conducive to facilitating a harmonious coexistence of uses in agricultural zones. The municipalities must apply the standards in the Guidelines within the framework of section 38 of the Act to amend the Act respecting the preservation of agricultural land and agricultural activities and other legislative provisions (2001, chapter 35) for the time indicated therein. In the same way, the municipalities must consider the Guidelines to the extent provided for in the Regulation respecting the implementation of the Act to amend the Act respecting the preservation of agricultural land and agricultural activities and other legislative provisions (chapter P-41.1, r. 4).

2. DEFINITIONS
Dwelling
A dwelling having an area of at least 21 m2 that does not belong to the owner or operator of the livestock facilities concerned or to a shareholder or manager owning or operating the facilities.
Protected immovable
(a)  a business;
(b)  a recreational, sports or cultural centre;
(c)  a municipal park;
(d)  a public beach or marina;
(e)  land belonging to an educational institution or an institution within the meaning of the Act respecting health services and social services (chapter S-4.2);
(f)  a campground;
(g)  buildings of an outdoor recreational area or a nature interpretation centre;
(h)  a ski lodge or golf clubhouse;
(i)  a religious temple;
(j)  a summer theatre;
(k)  a tourist accommodation establishment within the meaning of the Regulation respecting tourist accommodation establishments (chapter E-14.2, r. 1), except bed and breakfast establishments, tourist homes or basic furnished lodgings;
(l)  buildings used for wine tasting purposes in vineyards or restaurants of 20 seats or more that hold a year-round operating permit, and facilities for country or any other similar form of dining where the eating facilities do not belong to the owner or operator of the livestock facilities concerned.
Protected heritage site
A heritage site recognized by a competent jurisdiction and shown on the land use planning and development plan.
Municipal urbanization perimeter
The boundary envisaged for the growth of a municipality’s urban areas, as defined in its land use planning and development plan, with the exception of any portion of the perimeter in an agricultural zone.
Marina
Tourist installation that comprises a pleasure-boat harbour and the facilities that border the harbour and that is shown on the land use planning and development plan.
Campground
Establishment offering to the public, in return for payment, sites to accommodate tents or recreational camping vehicles, with the exception of a campground on a farm that belongs to the owner or operator of the livestock facilities concerned.
Solid manure management
A method of removing manure from a livestock facility or storage works where the water content is lower than 85% leaving the building.
Liquid manure management
A method of removing manure other than by solid manure management.
Livestock facility
A facility where animals are raised or an enclosure or part of an enclosure where animals are kept for purposes other than pasture including, where applicable, any manure storage works in the facility or enclosure.
Livestock unit
A livestock facility or, where there is more than one facility, all the livestock facilities in respect of which a point on the perimeter of one facility is less than 150 m from the neighbouring livestock facility, and from storage works, if any, for the manure from the animals in the facility or facilities.

3. SEPARATION DISTANCES FOR LIVESTOCK FACILITIES
The separation distances for livestock facilities are obtained by multiplying the set of parameters B, C, D, E, F and G appearing below.
The parameters are as follows:
Parameter A: maximum number of livestock units (LU) kept during an annual production cycle. It is used to determine parameter B and is established using the table in Schedule A.
Parameter B: base distance. It is established by locating, in the table appearing in Schedule B, the base distance corresponding to the value calculated for parameter A.
Parameter C: odour coefficient. The table in Schedule C shows the odour coefficient according to the group or category of animals in question.
Parameter D: manure type. The table in Schedule D gives the value of the parameter in relation to the farm manure management practice.
Parameter E: project type. When a livestock unit has availed itself in totality of the development right under the Act respecting the preservation of agricultural land and agricultural activities (chapter P-41.1), or to increase livestock by more than 75 LU, the applicable separation distances may be relaxed in its respect, subject to the content of Schedule E, up to a maximum of 225 LU.
Parameter F: attenuation factor. This parameter appears in Schedule F. It enables integration of the odour attenuation effect resulting from the technology used.
Parameter G: use factor. It is based on the type of neighbouring unit in question. Schedule G gives the value of the factor.

4. RECONSTRUCTION AFTER A FIRE OF A NON-CONFORMING LIVESTOCK FACILITY PROTECTED BY ACQUIRED RIGHTS
Where a non-conforming livestock facility protected by acquired rights is destroyed by fire or any other cause, the municipality shall ensure that the producer affected can continue to carry on activities1, and that the erection of new facilities takes place in compliance with the by-laws in force, in such manner as to improve the previous situation in terms of harmonious co-existence with neighbouring uses, subject to the application of a by-law adopted under the third paragraph of section 118 of the Act respecting land use planning and development (chapter A-19.1). Among other things, the side and front spaces prescribed in the municipal by-laws must be respected. If it is not possible to respect the standards under the by-laws, a minor exemption to the provisions of the zoning by-law may be granted to enable the main facility and accessory structures to be rebuilt2.

2 Under section 145.1 and following of the Act respecting land use planning and development, the council of a municipality may grant a minor exemption if a person cannot respect the by-laws in force if the application of the by-law causes a serious prejudice to the applicant. However, a minor exemption may not be granted if it hinders the owners of the neighbouring immovables in the enjoyment of their right of ownership.

5. SEPARATION DISTANCES FOR FARM MANURE STORAGE SITES SITUATED MORE THAN 150 METRES FROM LIVESTOCK FACILITIES
When farm manure is stored outside the livestock facility, separation distances must be respected. They are established on the consideration that one livestock unit (LU) requires a 20 m3 storage capacity. For example, the value of parameter A, in the case of a 1,000 m3 capacity tank, corresponds to 50 LU. Once that equivalence has been determined, it is possible to determine the corresponding base distance using Table B. The formula multiplying the set of parameters B, C, D, E, F and G may then be applied. The following table illustrates cases where C, D and E equal 1, with G varying according to the neighbouring unit considered.

6. SEPARATION DISTANCES FOR SPREADING FARM MANURE
The nature of the farm manure and the equipment used are the determining factors in the separation distances to respect for spreading. The distances proposed in the following table are a compromise between spreading practices and protection of other uses in rural areas. The use of sprinklers or cannons is prohibited under the provisions of the regulations of the Ministère du Développement durable, de l’Environnement et des Parcs. Farm manure must be spread in keeping with the separation distances appearing in the following table:

(1) For the purposes of determining parameter A, the animals listed in the table below are equivalent to one livestock unit in relation to the number prescribed.
(2) For any other animal species, an animal weighing 500 kg or more or a livestock group of that species whose total weight is 500 kg is equivalent to one livestock unit.
