Regulation respecting the signing of certain deeds, documents and writings of the Ministère de la Culture et des Communications
Act respecting the Ministère de la Culture et des Communications
(chapter M-17.1, ss. 7 and 8).
1. The permanent or acting functionaries of the Ministère de la Culture et des Communications holding the positions mentioned in this Regulation are authorized within the limits of their respective duties, to sign on behalf of the Minister of Culture and Communications and with the same effect, the deeds, documents and writings listed after their respective positions, subject to the Financial Administration Act (chapter A-6).

2. The Assistant Deputy Minister for Administration is authorized to sign:
(1)  contracts for the acquisition of immovables;
(2)  construction contracts;
(3)  contracts of renting immovables, in the capacity of lessor;
(4)  deeds, documents and writings listed in sections 5 and 6.

3. The Assistant Deputy Minister for National Institutions is authorized to sign:
(1)  contracts for the acquisition of immovables;
(2)  construction contracts;
(3)  contracts for renting immovables, in the capacity of lessor;
(4)  deeds, documents and writing listed in paragraphs 1 to 4 of section 5 and in sections 7, 9, 11 and 13.

4. The Assistant Deputy-Minister for Cultural Milieus is authorized to sign:
(1)  contracts for the acquisition of immovables;
(2)  authorizations referred to in sections 42, 48, 52, 64 and 65 of the Cultural Heritage Act (chapter P-9.002) and that involve the Government of Canada, its departments and agencies;
(3)  deeds, documents and writings listed in paragraphs 1 to 4 of section 5 and in sections 14, 17 and 18.

5. The Director General of the Direction générale de l’administration is authorized to sign:
(1)  service contracts;
(2)  contracts for renting movables;
(3)  contracts for the acquisition of movables, local orders and delivery orders;
(4)  agreements and understandings respecting the terms for paying and using subsidies;
(5)  contracts, contractual documents and occupancy agreements with the Société québécoise des infrastructures.

6. The Director of the Direction des ressources financières et des systèmes de gestion is authorized to sign the deeds, documents and writing listed in paragraphs 1 to 4 of section 5 and the data processing service contracts with the Ministère de la Culture et des Communications.
The Director of the Direction des ressources matérielles is authorized to sign the deeds, documents and writings listed in paragraphs 1 to 4 of section 5 and telephony service contracts with the Ministère de la Culture et des Communications.
The Head of the Division de l’approvisionnement is authorized to sign the deeds, documents and writings listed in paragraph 3 of section 5 except contracts for the acquisition of movables.

7. The Keeper of the Archives nationales du Québec is authorized to sign:
(1)  deeds, documents and writings listed in paragraphs 1 to 4 of section 5;
(2)  authorizations referred to in the second paragraph of section 16 of the Archives Act (chapter A-21.1);
(3)  requests for advice to the Conseil du patrimoine culturel referred to in sections 11, 16, 22, 38 and 52 of the Archives Act;
(4)  decisions referred to in section 51 of the Archives Act;
(5)  approvals, notifications, notices and understandings referred to in section 52 of the Archives Act;
(6)  deeds of acquisitions, by purchase or otherwise, of documents, archives or movable heritage property;
(7)  agreements to deposit, loan or donate documents or archives, in the capacity of donee;
(8)  receipts for donations or legacies of documents or archives.

8. Assistant-Keepers of the Archives nationales du Québec are authorized to sign:
(1)  deeds, documents and writings listed in paragraphs 1 to 4 of section 5;
(2)  deeds, documents and writings listed in paragraphs 4 to 7 of section 7.

9. The Bibliothèque nationale du Québec is authorized to sign:
(1)  deeds, documents and writings listed in paragraphs 1 to 4 of section 5;
(2)  deeds of acquisition, by purchase or otherwise, of documents under the Act respecting the Bibliothèque nationale du Québec (chapter B-2.1);
(3)  agreements to deposit, loan or donate documents, in the capacity of donee;
(4)  receipts for donations or legacies of documents.

10. Directors of the Bibliothèque nationale du Québec are authorized to sign:
(1)  deeds, documents and writings listed in paragraphs 1 to 4 of section 5;
(2)  deeds, documents and writings listed in paragraphs 2 and 3 of section 9.

11. The Director General of the Conservatoire de musique et d’art dramatique du Québec is authorized to sign:
(1)  deeds, documents and writings listed in paragraphs 1 to 4 of section 5;
(2)  contracts for hiring speakers, visiting professors and any other professionals required to prepare and carry out educational activities;
(3)  contracts for hiring lecturers, teaching assistants, monitors and orchestra managers;
(4)  contracts for purchasing musicological and theatrical collections;
(5)  contracts for lending musical instruments, costumes, furniture, stage settings and accessories.

12. Sections Directors of the Conservatoire de musique et d’art dramatique du Québec are authorized to sign:
(1)  deeds, documents and writings listed in paragraphs 1 to 4 of section 5;
(2)  deeds, documents and writings listed in paragraphs 2 to 5 of section 11.

13. The Director of the Centre de conservation du Québec is authorized to sign the deeds, documents and writings listed in paragraphs 1 to 4 of section 5.

14. The Director General of the Direction générale des arts et des lettres is authorized to sign:
(1)  deeds, documents and writings listed in paragraphs 1 to 4 of section 5;
(2)  a deed designating a person to replace a member of a standing committee referred to in section 12.2 of the Règlement sur l’intégration des arts à l’architecture et à l’environnement des édifices du Gouvernement du Québec (R.R.Q., 1981, c. M-20, r. 3);
(3)  requests for advice to the advisory board on reading and the book industry referred to in sections 8, 24 and 38 of the Act respecting the development of Québec firms in the book industry (chapter D-8.1);
(4)  notices and requests for information referred to in sections 23 and 37 of the Act respecting the development of Québec firms in the book industry;
(5)  certificates of accreditation, notices respecting the refusal to issue a certificate of accreditation and the notices, decisions and certified copies of the decisions respecting the cancellation or the suspension of a certificate of accreditation referred to in sections 19, 21, 23 and 25 of the Act respecting the development of Québec firms in the book industry;
(6)  (paragraph revoked).

15. The Director of the Direction des services aux artistes is authorized to sign:
(1)  deeds, documents and writings listed in paragraphs 1 to 4 of section 5;
(2)  deeds, documents and writings listed in paragraph 2 of section 14.

16. The Director of the Direction des industries culturelles is authorized to sign:
(1)  deeds, documents and writings listed in paragraphs 1 to 4 of section 5;
(2)  deeds, documents and writings listed in paragraphs 3 to 6 of section 14.

17. The Director General of the Direction générale du patrimoine is authorized to sign:
(1)  deeds, documents and writings listed in paragraphs 1 to 4 of section 5;
(2)  construction contracts;
(3)  contracts for renting immovables, in the capacity of lessor;
(4)  purchase contracts for movable heritage property;
(5)  certified extracts from the cultural heritage register referred to in section 6 of the Cultural Heritage Act (chapter P-9.002);
(6)  (paragraph implicitly revoked, 2011, c. 21, s. 258);
(7)  requests for advice to the Conseil du patrimoine culturel referred to in sections 29, 40, 58, 165 and 168 of the Cultural Heritage Act;
(8)  authorizations, approvals, notices, decisions, declarations, notifications, amendments, revocations, permits and permissions referred to in sections 42, 47, 48, 52, 64, 65, 68, 166, 168 and 197 of the Cultural Heritage Act;
(9)  (paragraph implicitly revoked, 2011, c. 21, s. 241);
(10)  (paragraph implicitly revoked, 2011, c. 21, s. 258);
(11)  letters from the Minister of Culture and Communications by which she indicates that she has no intention of acquiring heritage property or a document under section 56 of the Cultural Heritage Act.

18. The Director General of the Direction générale des régions and a Director in a Direction régionale are authorized to sign deeds, documents and writings listed in paragraphs 1 to 4 of section 5.

19. All the other directors are authorized to sign the deeds, documents and writings listed in paragraphs 1 to 4 of section 5.
Heads of services, regional archivists, management officers and management executives are authorized to sign the deeds, documents and writings listed in paragraphs 1 to 3 of section 5.

19.1. The persons who have the rank of assistant or associate deputy minister at the department and those who hold a position of director, director general and regional director are authorized, within the limits of their respective duties, to sign any document pertaining to the promise or granting of subsidies from one of the following programs, approved, as the case may be, by the Minister, the Conseil du trésor or the Government:
(1)  the operational assistance program concerning
— regional service centres for public libraries;
— recognized museums;
— pluridisciplinary distributors in the performing arts;
— advanced art training organizations;
— specialized art training organizations (preparatory or recreation);
— national heritage organizations;
— national organizations for young amateurs and national cultural recreation organizations;
— umbrella organizations;
— community media; and
— local aboriginal radio stations;
(2)  the project assistance program concerning stand-alone public library collection development projects.

20. A facsimile of the signature of the Minister, the Deputy Minister or the holders of the positions specified in this Regulation may be engraved, printed or lithographed on any of the documents that the person is authorized to sign under the Act respecting the Ministère de la Culture et des Communications (chapter M-17.1), of this Regulation or of one of the other Acts which is entrusted to the application of the Minister, where those documents are countersigned by a person authorized by the Minister.
