Regulation respecting the Gazette officielle du Québec

Act respecting the Ministère de l’Emploi et de la Solidarité sociale and the Commission des partenaires du marché du travail

(chapter M-15.001, s. 57.3.5).

The former alphanumerical designation of this Regulation was chapter C-8.1.1, r. 1.

DIVISION I CONTENT AND PUBLICATION DATES

1. The Gazette officielle du Québec shall comprise 2 parts:

(1)  Part 1, entitled “Avis juridiques”; and

(2)  Part 2, entitled in English “Laws and Regulations” and in French “Lois et règlements”.

Part 1, the French Edition of Part 2 and the English Edition of Part 2 shall be published separately.

2. Part 1 shall contain documents, announcements and notices other than those published in Part 2 and whose publication in the Gazette officielle du Québec is required by a law or regulation, or by the Government.

3. The French Edition of Part 2 shall contain the French version of

(1)  Acts assented to;

(2)  proclamations and Orders in Council for the coming into force of Acts;

(3)  regulations and other statutory instruments whose publication in the Gazette officielle du Québec is required by law or by the Government;

(4)  Orders in Council, decisions of the Conseil du trésor and minister’s orders whose publication is required by law or by the Government;

(5)  regulations made by courts of justice and quasi-judicial tribunals;

(6)  drafts of the texts referred to in paragraphs 3 and 5 whose publication in the Gazette officielle du Québec is required by law before they are made, adopted or issued by the competent authority or before they are approved by the Government, a minister, a group of ministers or a government body; and

(7)  any other document not referred to in section 2 or in this section and whose publication is required by the Government.

4. The English Edition of Part 2 shall contain the English version of

(1)  Acts assented to;

(2)  proclamations and Orders in Council for the coming into force of Acts;

(3)  regulations and other statutory instruments whose publication in the Gazette officielle du Québec is required by law or by the Government;

(4)  regulations made by courts of justice and quasi-judicial tribunals;

(5)  drafts of the texts referred to in paragraphs 3 and 4 whose publication in the Gazette officielle du Québec is required by law before they are made, adopted or issued by the competent authority or before they are approved by the Government, a minister, a group of ministers or a government body; and

(6)  any other document published in the French Edition of Part 2, where the Government orders that the document also be published in English.

5. Part 1 shall be published at least every Saturday. If a Saturday is a legal holiday, the Québec Official Publisher shall publish Part 1 on the preceding day or on the following Monday.

Part 2 shall be published at least every Wednesday. If a Wednesday is a legal holiday, the Québec Official Publisher shall publish Part 2 on the preceding day or on the following day.

DIVISION II RATES

6. The annual subscription price for the Gazette officielle du Québec in paper form is

(1)  $589 for Part 1; and

(2)  $808 for the English or French edition of Part 2.

7. The selling price of an issue of the Gazette officielle du Québec is $12.61 per copy in paper form.

9. The rate payable for the publication of documents, notices and announcements in Part 1 is $2.03 per agate line.

The costs shall be paid by the person or authority requesting the publication or, where the publication is requested by the Government, by the person or authority issuing the document, notice or announcement.

10. The rate payable for publishing a document in Part 2 is $1.35 per agate line. A minimum rate of $295 is applied, however, in the case of a publication of fewer than 220 agate lines.

The costs shall be paid by:

(1)  in the case of an Act, Proclamation or Order in Council for the coming into force of an Act, the Minister responsible for the application of the Act concerned;

(2)  the person or authority adopting or making regulations or other statutory instruments or, where they are made by the Government, the Minister recommending they be adopted or made;

(3)  the person or authority recommending the adoption or making of an Order in Council, Conseil du trésor decision or Minister’s order, in the case of Orders in Council, Conseil du trésor decisions or Minister’s orders;

(4)  the court or tribunal, in the case of regulations made by a court or tribunal; or

(5)  in all other cases, the person or authority issuing the document.

If the costs may be paid by more than one person or authority, they shall be paid by the issuer of the document.

11. The amounts set forth in sections 6 to 10 shall be indexed on 1 January 2005 and on 1 January of each year thereafter on the basis of the rate of increase in the general Consumer Price Index for Canada for the period ending on 30 September of the preceding year, as determined by Statistics Canada.

The rates and prices thus indexed that are less than $35 shall be reduced to the nearest cent if they contain a fraction of a cent less than 0.5 cents; they shall be increased to the nearest cent if they contain a fraction of a cent equal to or greater than 0.5 cents.

The rates and prices thus indexed that are equal to or greater than $35 shall be reduced to the nearest dollar if they contain a fraction of a dollar less than $0.50; they shall be increased to the nearest dollar if they contain a fraction of a dollar equal to or greater than $0.50.

The Québec Official Publisher shall publish the result of the annual indexing in the Gazette officielle du Québec.

13. This Regulation replaces the Regulation respecting the Gazette officielle du Québec (O.C. 3333-81, 81-12-02).
