Regulation respectiong a new election notice following a candidate’s death

GENERAL
1. The Interpretation Act, (chapter I-16) applies to this Regulation.

NOTICE OF A NEW ELECTION
2. As soon as he learns of the death of a candidate, the returning officer shall so advise the Chief Electoral Officer.

3. Polling day is postponed where a candidate dies between the twenty-first day before the date of the poll and its closing. In such a case, the returning officer shall publish a notice at once in a newspaper distributed in the electoral division informing voters of the new period for the filing of nomination papers and of the new polling date, in accordance with Form 41 attached hereto.

4. The returning officer shall post a copy of the notice in his main office. He shall also forward a copy to each person who had stood as candidate in that electoral division.

NOTICE OF A NEW ELECTION FOLLOWING THE DEATH OF A CANDIDATE

Electoral Division:

Following the death of candidate __________(Name)__________ on the ____________________ day of ____________________, 20_____, the poll which was to have taken place on the ____________________ day of ____________________, 20_____, in the said electoral division is postponed. Consequently, a new election shall be held.
THEREFORE, notice is hereby given to the electors in the electoral division of ____________________ that:
(1) a new period for filing nomination papers is open and any person wishing to stand as a candidate at the election must file a duly completed nomination paper with my office no later than 2:00 p.m. on the second Monday following the death of the candidate, namely, Monday, the ____________________ day of ____________________, 20 _____; and
(2) if necessary, polling will take place on the second Monday that follows, namely, Monday, the ____________________ day of ____________________, 20 _____, from __________ a.m. to __________ p.m.
