Regulation respecting professional examinations of the Ordre des chiropraticiens du Québec

DIVISION I
ADMISSIONS COMMITTEE
1. The board of directors of the Ordre des chiropraticiens du Québec shall set up an admissions committee of 3 chiropractors appointed from among the members of the Order who have been practising for not less than 3 years. They shall be appointed for a 3-year term, which may be renewed by the board of directors. They shall assume their duties when appointed by the board of directors and shall remain in office until they resign, are replaced or are struck off the roll; the board of directors shall appoint a chair of the committee from among its members.

2. In addition to the duties entrusted to it by this Regulation, the committee shall study applications for permits and shall recommend that the board of directors issue a permit if the candidate satisfies the conditions prescribed by the Professional Code (chapter C-26), the Chiropractic Act (chapter C-16) and any regulations thereunder.
The committee shall also make recommendations to the board of directors concerning the professional examination of the Order.

3. The decisions and recommendations of the committee shall be made by a majority of the members entitled to vote.

4. The committee may add experts, who may take part in the deliberations, but may not vote.

5. Each member of the committee and each expert member shall take the oath prescribed by Schedule II to the Professional Code (chapter C-26).

6. Every member of the committee shall immediately inform the other members of any risk of collusion or partiality in the committee of which he has knowledge.

7. No member of the committee who is related by birth or marriage to a candidate up to and including first cousin may take part in a decision or a recommendation concerning such candidate.

8. The secretariat of the committee shall be located at the head office of the Order. All reports and other documents of the committee shall be kept there.

DIVISION II
THE EXAMINATION
9. The Order shall hold at least one professional examination per year, at a place and time set by the board of directors.

10. A candidate may take the examination if he holds a doctor’s degree in chiropractic issued by an educational institution mentioned in section 4.01 of the Regulation respecting the diplomas issued by designated educational institutions which give access to permits or specialist’s certificates of professional orders (chapter C-26, r. 2) or a diploma considered equivalent by the board of directors in accordance with the Regulation respecting the standards of equivalence for the issuance of a permit of the Ordre des chiropraticiens du Québec (chapter C-16, r. 10).

11. Not less than 60 days before the holding of the examination, the secretary of the Order shall transmit to each of the educational institutions listed in section 4.01 of the Regulation respecting the diplomas issued by designated educational institutions which give access to permits or specialist’s certificates of professional orders (chapter C-26, r. 2), a notice in the form prescribed by Schedule A.

12. A candidate who wishes to take the professional examination shall send to the secretary of the Order, not less than 30 days before the date prescribed for the examination, the following documents:
(1)  a duly completed copy of the registration form prescribed by Schedule B;
(2)  his school record;
(3)  a recent 25 cm2 photograph certified over his signature as his;
(4)  an authenticated copy of his act of birth or satisfactory evidence of the date and place of birth;
(5)  the amount set by resolution of the board of directors for opening a file.

13. The committee shall study each application for the examination and shall recommend to the board of directors, for each candidate, whether or not he should be admitted to the examination.

14. Where the board of directors observes, upon report by the committee, that a candidate satisfies the conditions for admission, the secretary shall send him a certificate of admission in the form prescribed by Schedule C, not less than 10 days before the date prescribed for the examination.

15. Candidates taking the examination shall pay the amount set by resolution of the board of directors to cover the costs of the examination.

16. There are 2 parts to the examination:
(1)  a written examination dealing with the following subjects:
— general anatomy;
— anatomy of the spinal column;
— biochemistry;
— chemistry;
— chiropractic diagnosis;
— neuromuscular skeletal diagnosis;
— microbiology;
— pathology;
— physiology;
— chiropractic techniques;
— chiropractic principles;
— radiology;
(2)  an oral examination dealing with the following subjects:
— neurological tests;
— orthopaedic tests;
— reflexology;
— pathology;
— chiropractic diagnosis;
— chiropractic techniques;
— nutrition;
— radiological interpretation;
— radiology;
— ethics: practice and precedents;
— laws and regulations governing the practice of chiropractic.

17. Every candidate must take the oral part of the examination mentioned in paragraph 2 of section 16.
Candidates holding a diploma awarded by the National Board of Chiropractic Examiners in the United States or by the Canadian Chiropractic Examining Board shall be exempted from the written part of the examination mentioned in paragraph 1 of section 16, except the radiological examination.

18. The board of directors shall determine the content of the examination, which shall contain written and oral tests.

19. The board of directors shall designate the persons to administer and evaluate the oral tests of the examination and to correct the written tests.

20. Any of the following practices shall be punished by expulsion of the candidate:
(1)  using or attempting to use books, documents, notes or objects other than those authorized for use in the examination;
(2)  plagiarizing, attempting to plagiarize or helping another candidate to plagiarize;
(3)  impeding the holding of the examination.

21. No candidate may have access to the room where a written examination is in progress after another candidate has left the examination room.

22. During marking of the written tests of the examination, the anonymity of the candidates shall be preserved.

23. Examination answers shall be destroyed 6 months after the examination.

24. The marking of the examination shall be expressed as follows:
— the letter “A” means excellent;
— the letter “B” means good;
— the letter “C” means satisfactory;
— the letter “D” means unsatisfactory.

25. To pass, candidates must obtain at least a “C”.

26. As soon as the marking or evaluation has been completed, the person in charge shall draw up a list of the candidates who have passed the examination and those who have failed. The report shall be signed by the members of the committee and sent to the board of directors without delay.

27. Within 10 days of drawing up the committee report, the secretary shall send to each candidate a statement of his success or failure and his mark.

28. A candidate who is given a mark of “D” may, within 60 days of receiving notice of his failure, request the board of directors to review the evaluation and the marking of his examination. The board of directors may change the mark assigned to the candidate.

29. The board of directors must allow candidates to see their answer papers within 60 days of the sending of the notice prescribed by section 27.

DIVISION III
PERMITS
30. The board of directors shall issue a permit to a person applying for it who satisfies the conditions set out in the Professional Code (chapter C-26), the Chiropractic Act (chapter C-16), the regulations and section 35 of the Charter of the French language (chapter C-11), and has paid the secretary the amount fixed by resolution of the board of directors to cover the cost of issuing the permit.
